1. SCOPE & CONTRACTUAL PARTNER
1.1 These General Terms and Conditions (GTC) govern all contracts for the rental of apartments and flats for accommodation between Laura Weber and the guests, as well as all other services and deliveries provided by this company.
1.2 Laura Weber is the contractual partner of the guests.
1.3 Customer GTCs are only considered if an explicit agreement in text form exists.
2. RESERVATIONS/BOOKINGS
2.1 By making a reservation/booking, the guest offers to conclude an accommodation contract with Laura Weber. Subject to availability of the desired apartment, Laura Weber will send a confirmation, thereby establishing the accommodation contract.
2.2 Laura Weber reserves the right to keep offers for apartments non-binding and to independently decide on the conclusion of accommodation contracts.
2.3 If the guest books only a category and not a specific apartment, there is no entitlement to a particular apartment unit. Laura Weber reserves customary restrictions such as minimum stays and deposits.
3. CANCELLATION PERIODS/WITHDRAWAL OF THE GUEST/NO SHOW
3.1 A binding reservation exists only after payment has been made by the guest. Cancellations can be made free of charge according to the specified conditions and deadlines. Without an agreed right of withdrawal or after the expiration of the cancellation period, Laura Weber's claim to the agreed remuneration remains, even in the case of non-use (no show) or late cancellation. Laura Weber will consider other rental income and saved expenses. If the rooms are not re-rented, Laura Weber can charge a flat rate for saved expenses, and the guest must pay 100% of the agreed price.
4. ACCOMMODATION PRICES & OTHER PRICES
4.1 The prices stated by Laura Weber at the time of contract conclusion apply. These are gross prices and include all legal taxes, fees, and charges. Local charges, such as tourist taxes payable by the guest, are not included.
5. PAYMENT TERMS & INVOICE
5.1 The price for the booked accommodation service must be paid in advance by the guest.
5.2 Offsetting by the guest is excluded unless it concerns an undisputed or legally established claim.
5.3 Accepted payment methods are Paypal or regular bank transfer. Cash payments are not accepted.
5.4 Laura Weber reserves the right to charge deposited payment methods for additional services or violations of the GTCs, with the guest expressly authorizing Laura Weber to do so.
5.5 By making a reservation, the guest agrees to receive their invoice digitally or by email.
6. USAGE OPPORTUNITIES OF RESERVED APARTMENTS
6.1 A reserved apartment is available to the guest for the period specified after booking.
6.2 Keys, parking permits, and/or key cards provided by Laura Weber must be returned on the day of departure. In the event of loss or non-return, a fee of 100.00 € will be charged. Laura Weber may demand further damages if the damage exceeds 100.00 €.
6.3 A later departure (late check-out) can be agreed upon between Laura Weber and the guest. If a late check-out is agreed upon, Laura Weber may charge 10.00 € per hour started. Without consent, the charge is 30.00 € per hour. If the departure is more than 3 hours after the agreed check-out, the full accommodation price will be charged.
6.4 There is no contractual claim to a late check-out. An earlier arrival (early check-in) can be agreed upon between Laura Weber and the guest, with 10.00 € charged for each hour started. There is no contractual claim to an early check-in.
7. TRANSFER, SUBLETTING, USAGE
7.1 Subletting or transferring the reserved apartments is prohibited. This particularly includes transferring to third parties at higher prices than indicated by Laura Weber. Also, assignment or sale of claims against Laura Weber is not permissible. In case of violations, Laura Weber may cancel the reservation, especially if false information about the nature of the booking or payment was provided.
7.2 The use of Laura Weber's apartments for purposes other than accommodation, such as commercial or illegal uses, is expressly prohibited. Without explicit consent, use for photo or video shoots is also forbidden. Laura Weber can cancel the reservation without refunds and vacate the apartment in such cases.
8. LIABILITY OF LAURA WEBER
8.1 Laura Weber is liable without limitation for damages resulting from injury to life, body, or health. For other damages, Laura Weber is liable only in case of intent or gross negligence. In cases of simple negligence, liability is limited to the typically foreseeable damage.
8.2 In case of disturbances or defects, Laura Weber will endeavor to remedy the situation upon notification by the guest or upon knowledge. The guest is also obliged to contribute to the rectification of the defect.
8.3 Laura Weber is legally liable for items brought in by guests. A claim of the guest expires if they do not promptly notify Laura Weber upon becoming aware of loss or damage.
8.4 Laura Weber is not liable for vehicles parked on a parking space provided by Laura Weber, except in cases of intent or gross negligence.
8.5 Claims against Laura Weber generally expire one year from the statutory start of the limitation period. This does not apply to compensation claims for injury to life, body, or health.
8.6 Laura Weber is not liable for lost and found items, unless the liability arises from intentional or grossly negligent breaches of duty. Lost and found items are returned only upon request and against a fee, and are kept for 14 days.
9. DEPOSIT
9.1 To secure all claims of Laura Weber against the guest resulting from the accommodation contract, Laura Weber may require a deposit:
9.1.1 For a stay of less than three months, the deposit amount is 250.00 €.
9.1.2 For a stay of three to six months, the deposit is the equivalent of one month's accommodation price.
9.1.3 For stays of less than three months, the deposit can be made by pre-authorization of the payment method.
9.2 The deposit will be settled within one month after the end of the accommodation contract.
10. CUSTOMER DATA
10.1 Laura Weber mandatorily collects email addresses and phone numbers of guests to ensure communication. A valid identification document is required at check-in (national ID card or passport for domestic guests, passport for foreign guests).
10.2 If a guest's identity cannot be conclusively clarified due to missing or incorrect documents, Laura Weber reserves the right to cancel the booking.
11. TERMINATION OF THE ACCOMMODATION CONTRACT
11.1 Laura Weber reserves the right to terminate the accommodation contract for important reasons. Important reasons include force majeure, the assumption that the use of services could endanger the image of Laura Weber, misleading or false information at booking, unlawful purpose of use, or resale/subletting.
11.2 In the event of justified termination by Laura Weber, the guest has no right to compensation.
11.3 If the termination by Laura Weber is due to a circumstance attributable to the guest, Laura Weber may cancel or reject future bookings of the guest.
12. VOUCHERS
12.1 Vouchers from Laura Weber can only be redeemed for services provided by Laura Weber. Remaining credit stays valid and is not convertible into cash. The purchaser of the voucher is responsible for providing correct information.
13. SMOKING BAN
13.1 All apartments of Laura Weber are non-smoking. In case of violation, Laura Weber may demand compensation for additional cleaning costs and loss of income.
13.2 Tampering with safety equipment is prohibited and may result in a fine.
13.3 In case of violations of the smoking ban or tampering with safety equipment, Laura Weber may immediately terminate the booking and expel the guest from the property. Refunds are not provided in these cases.
14. PROHIBITION OF PARTIES AND GATHERINGS
14.1 Noise in the apartment and in the communal areas should be avoided. Parties and gatherings in the apartments and communal areas are strictly prohibited.
14.2 In case of violations, Laura Weber may demand compensation for additional cleaning costs and loss of income.
14.3 Sensors to measure decibel levels may be installed in the apartments to detect excessive noise.
14.4 In case of violations, Laura Weber may immediately terminate the booking and expel the guest from the property. Refunds are not provided in these cases.
15. DAMAGE OR UNAUTHORIZED REMOVAL OF INVENTORY
15.1 In case of damages or unauthorized removal of inventory, Laura Weber has a right to compensation, including the cost of repairing the damage and potential loss of income.
16. PETS
16.1 Pets are not allowed in the apartments and communal areas, except for certain service dogs.
16.2 In case of unauthorized presence of pets, a special cleaning fee will be charged.
17. MAINTENANCE
17.1 The guest agrees to treat the apartment gently and carefully. In case of excessive dirt, Laura Weber may charge an additional cleaning fee. The guest is also obliged to report any defects or damages immediately.
17.2 On arrival, the guest is obliged to check the completeness and usability of the apartment's furnishings and report any defects immediately.
17.3 The guest is liable for damages resulting from contractually improper use. Such damages must be reported to Laura Weber immediately.
17.4 For bookings of more than 7 nights, Laura Weber is entitled to carry out weekly interim cleanings.
18. INTERNET USE
18.1 Laura Weber provides internet access, although disruptions may occur. The usage must not be abusive.
18.2 Abusive use includes, in particular, downloading and distributing copyrighted content, illegal streaming offers, and accessing or transmitting content that is criminally relevant. The guest is responsible for observing the rights of third parties, such as copyright, patent, name, trademark, and personal rights. The guest indemnifies Laura Weber from all claims and demands for damages from third parties, as well as legal defense costs, that arise from unlawful use of the provided internet connection by the guest or by third parties with the knowledge of the guest.
18.3 Sharing the internet access data with third parties is prohibited. This also applies to the publication of any access data. In the event of a violation, the guest is responsible for all damages incurred by Laura Weber due to the sharing of access data.
18.4 In the case of legal violations, Laura Weber reserves the right to block the guest's internet access.
20. DATA PROTECTION
20.1 Laura Weber's privacy policy can be viewed at the specified URL.
21. FINAL PROVISIONS
21.1 Changes and amendments to the contract or the GTCs require written form. Unilateral changes or additions by the guest are ineffective.
21.2 The place of fulfillment and payment is the location of the accommodation business.
21.3 The exclusive place of jurisdiction, in commercial transactions, is the location of the accommodation business, provided the contractual partner does not have a general place of jurisdiction in the country.
21.4 German law applies. The application of the UN Convention on Contracts for the International Sale of Goods and conflict of laws is excluded.
21.5 Should any provision of this contract be or become invalid or void, the validity of the remaining provisions shall not be affected. In place of the ineffective/void provision, the parties shall agree upon a provision that comes closest to the intended purpose of the ineffective/void provision. This also applies to filling any contractual gaps.
21.6 Laura Weber is not obligated to participate in dispute resolution proceedings before a consumer arbitration board.
